Kabhi-kabhi court ka kaam sirf baad me damages dena nahi, balki turant nuksaan rokna bhi hota hai. Yahin pe injunctions ka role aata hai. Simple language me, injunction ek court order hota hai jo kisi party ko “ye kaam mat karo” ya “ye kaam karo” bolta hai.
Temporary (interim) injunction tab diya jata hai jab case abhi chal raha ho aur judge ko lage ki agar abhi kuch na kiya gaya to irreparable harm ho sakta hai. Jaise kisi ne aapke plot pe illegal construction start kar diya, ya competitor confidential data misuse kar raha ho. Court dekhta hai: prima facie case, balance of convenience, aur irreparable injury. Phir wo limited period ke liye order pass karta hai – matter decide hone tak status quo maintain karne ke liye.
Permanent injunction final judgment ke saath aata hai. Yahan court full evidence dekh ke decide karta hai ki future me bhi defendant ko koi act karne se rokna zaroori hai – for example, trade mark infringement, repeated trespass, ya constant nuisance cases me.
Injunctions ka misuse avoid karne ke liye courts cautious bhi rehte hain. Frivolous cases, mala fide motives, ya purely money disputes me normally injunction nahi milta. Plaintiffs ko bhi clean hands ke principle pe khara utarna padta hai – jinhone khud rule-break kiya ho, unke liye relief milna mushkil ho jata hai.
