Easements and Right of Way: Legal Use of Neighbour’s Land for Access or Utilities

Socho aapka plot road se directly connected nahi; beech me neighbour ki land hai. Ya aapke drain/ pipeline unke zameen se guzarte hain for decades. Aise cases me easement ka concept kaam aata hai – limited right to use someone else’s land for a specific purpose.

Common easements:

  • Right of way (raasta use karna),
  • Right to light and air,
  • Right to discharge water,
  • Right to lay cables or pipelines.

Easements create ho sakte hain express agreement se, ya long-term usage (prescription) se. Agar aap openly, peacefully, as-of-right neighbour ki land use karte rahe ho defined period tak, to law aapko easement recognise kar sakta hai.

Owner still land ka full malik rehta hai, lekin easement holder ka limited right usko respect karna padta hai. Wo raasta suddenly block nahi kar sakta, pipeline cut nahi kar sakta without process.

Disputes usually tab arise hote hain jab naye buyers old informal arrangements ko accept nahi karte. Isliye written records, maps, and revenue entries bohot kaam aate hain. Proper legal recognition easement ko “neighbour ki meherbani” se “enforceable right” bana deta hai.
